2      Types of personal information we collect and method of collection

We collect personal information to the minimum scope necessary for the provision of the game “Metal Slug: Commander “(hereinafter as “Metal Slug: Commander”, the “game” or the “services”). The personal information we collect may be freely provided by the user, or, in case of usage data, collected automatically when using our product and services.

2.1 For account registration

When creating your Metal Slug: Commander guest account, we would collect your device ID and location information from your mobile operating system to assist you in creating the account, finding your device, and recommending you to a nearby server.

When signing into our product and services with a social login or your credentials from a third-party platform (for example, Facebook, Google Play, Apple ID) and we may collect your date of birth and the personal information that you have agreed to share via the social media site or third-party platform in question.

2.2 While using our product and services

1)    to identify the user in the game and save its associated game data (level, purchase record, progress), we need to collect your OpenID (an automatically generated in-game account identifier).

2)    to manage and administer the services and improve your user experience including enhancing your interaction with other users in the game, we need to collect your game-related data, i.e., your friends information, ranking, battle results and videorecords of your game battles, user information of your in-game group (if any), chat history in the game.

3)    to perform internal review and optimize our services, we need to collect your device ID, MAC address, device hardware information, operating system version, network status and system logs.

4)    to keep track of game revenue and respond to related user complaints, we need to collect your purchase records provided by App Store or Google Play. If you make a purchase, your card information is not held by us, it is collected by App Store or Google Play, who specializes in the secure online capture and processing of credit/debit card transactions.

5)    to improve our advertising strategy and to measure ad effectiveness, we may collect your mobile phone number, your iOS IDFAs or Android Advertising IDs (“Mobile IDs, device ID, system logs including you sign-in data, your usage data such as your in-app purchase records based on your consent. We can, based on your consent, combine the data collected with our partners when you use our services and also combine this data with demographic, advertising and market studies or with other analytic surveys. If you wish to withdraw your consent or object to the personalization of adverts and content, please go to Article 8) to withdraw your consent.

6)    to prevent, detect and monitor any inappropriate conduct such as cheating, fraud and other toxic behaviors to the detriment of legitimate rights and interests of other users, our employees and company or any behaviors prohibited by the Terms of Service for Metal Slug: Commander. We need to collect your device ID, MAC address, device hardware information, operating system version, network status, system logs, game data and purchase records provided by App Store or Google Play.

7)    to contact us for customer support, we need to collect personal information such as your username, e-mail address, mobile phone number, depending on your questions or requests. If you contact us via social media, we will collect your personal information that you have agreed to share via the social media site only to appropriately respond to your questions and requests.

2.3 For promotional offers and pre-registration

When taking part in a contest or survey organized by us or pre-registering our product and services, we collect your last name, mobile phone number, email address, date of birth and if you participate via social media, we will collect your personal information that you have agreed to share via the social media sites only to administer the contest or the survey, to send you promotional offers and/or for internal statistical purposes.

3      Purposes of processing personal information

We process your personal information for specific purposes and process only the personal information relevant for achieving that purpose. Depending on our relationship with you and the products and services that we are providing, we use collected personal information for following purposes:

2)    for prevention of cheating, fraud and any other inappropriate behaviors within apps

3)    for game revenue tracking and related user complaints response

4)    for marketing and advertising distribution

5)    for analytics to optimize our services and improve user experience

7)    for communication of promotional offers and pre-registration

4      Sharing of personal information

In order to provide you with more convenient and prompt services, we share your personal information with our partners or entrust other companies with such tasks. We share your personal information with third-party service providers provided these third parties assume confidentiality obligations regarding your personal information collected.

We have engaged:

1)    analytics service providers (Adjust GmbH) to analyze and keep track of our user behavior and to provide marketing insights. We provide the Mobile advertising identifiers, i.e. iOS IDFAs and Android Advertising IDs (“Mobile IDs”), device ID, system logs including you sign-in data, your usage data such as your in-app purchase records with Adjust based on your consent. If you wish to withdraw your consent, including with regard to the personalization of adverts and content, please go to Article 8 to withdraw your consent. 2)    advertising service providers (Hong Kong Cheerlife Technology Limited) for marketing, advert distribution and promotion purposes. We provide your mobile phone number, your Mobile advertising identifiers, i.e. your Mobile IDs, device ID, system logs including you sign-in data, your usage data such as your in-app purchase records based on your consent. If you wish to withdraw your consent, including with regard to the personalization of adverts and content, please go to Article 8 to withdraw your consent. For this type of services, it may allow the third party to use and analyze your personal information for other purposes, we suggest that you check the privacy policy of the third-party site at https://cheerlife.info/en/.

3)    other technical service providers involved in the supply of the services (for example, cloud services, customer support, system monitoring and error report).

In addition, we may disclose your personal information in the following cases:

1)    where we are required to do so by applicable law or legal process.

2)    where when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity, as far as and to the extent permitted and/or required by applicable laws.

3)    where we sell or transfer all or part of our business or assets (including in the event of a reorganization, dissolution, or liquidation), as far as and to the extent permitted and/or required by applicable laws.

5      Retention and destruction of personal information

In general, we will store your personal information for one year after the termination of your Terms of Service with us, unless the retention of your personal information is necessary to meet legal or regulatory requirements, especially to comply with commercial and tax retention obligations, to resolve potential disputes or to preserve evidence within the scope of the statutory limitation provisions. Should this be the case, we will retain the personal information concerned until the end of the respective statutory period.

Thereafter, your personal information will be securely deleted or destroyed. Personal information stored in an electronic file format will be erased by a technical tool which prevents the recovery of the information. Personal information printed in a paper record, print media or a document is destroyed into scrap.

6      Security of personal information

We take appropriate security measures to prevent unauthorized access, disclosure, modification, unauthorized destruction of the personal information or any accidents such as hacking or computer viruses.

The processing of personal information is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition, we restrict the number of staff in charge with access to your personal information to the minimum level and frequently conduct training so that they comply with the confidentiality obligations with respect to your personal information.

Metal Slug: Commander may contain links to other websites and services run by other organizations. This privacy policy applies only to our product and services of Metal Slug: Commander‚ so we encourage you to read the privacy policies on the other websites and services you visit. We cannot be responsible for the privacy policies and practices of other sites even if you access them using links from our product.

In addition, if you linked to our product and services from a third-party site, we cannot be responsible for the privacy policies and practices of the owners and operators of that third party site and recommend that you check the policy of that third party site.

8      Your rights

Your rights related to your personal information will vary by jurisdiction and may include:

1)    the right to be fully informed of what personal information we collect, why we collect the data, and whether we intend to transfer it;

2)    the right to access your personal information and correct or update any errors;

3)    the right to have your personal information deleted;

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we verify your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We do not sell our email lists or other personal information we collect about you for money. However, we may share information with third parties in a way that is considered a “sale” under the CCPA. Where that is the case, we will comply with California “Do Not Sell” requirements.

Where that is the case, we will change the settings of Metal Slug: Commander interface as required by CCPA. And we will provide you with a clear and conspicuous link titled “Do Not Sell My Personal Information,” to an internet web page that enables you to opt-out of the sale of the consumer’s personal information. You can also exercise the right to opt out of sale of your personal information by submitting your request through the abovementioned two methods.

9.9 How we verify requests and respond to requests

Before fulfilling your request, we take steps to verify you are who you say you are or that you have authority to act upon someone else’s behalf. Therefore, upon receipt of your request, we will request additional information that we need to verify you and, if you are submitting a request on behalf of someone else, to verify that you are permitted to act on that person’s behalf. 

When we contact you to request verification information, please respond and provide the information that we have requested. Depending on the nature of the request you make, we may require you to verify your identity to either a reasonable degree of certainty or high degree of certainty. This may mean that we need to match two or three pieces of information that we hold about you with information that you provide to us. In some cases, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request or that you are authorized to make the request on behalf of someone else.

In addition to providing the information we need to verify you or your authority, you must provide us with enough information so that we can understand, evaluate, and respond to your request. We cannot delete personal information in those situations where our retention is required for our own internal business purposes or otherwise permitted by the CCPA (such as fraud prevention or legal compliance). In these situations, we will retain your information in accordance with our records retention program and securely delete it at the end of the retention period.

Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may also make request on behalf of your minor child. You may designate an authorized agent to make a request on your behalf by registering such person or entity with the California Secretary of State.

2)    How often you can submit requests?

You may make a CCPA consumer request twice within a 12-month period.

3)    Response timing and format

We make every attempt to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. When you request a copy of your personal information, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity easily.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

4)    Non-discrimination

We will not discriminate against you for exercising any of your CCPA rights. You have a right not to receive discriminatory treatment by us for exercising your privacy rights.

5)    Other California privacy rights

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to services@snk-corp.cn.

10   Nevada privacy rights

Nevada residents have the right to opt out of the sale of certain "covered information" collected by operators of websites or online services. We currently do not sell covered information.

3      Purposes of processing personal data

We process your personal data for specific purposes and process only the personal data relevant for achieving that purpose. Depending on our relationship with you and the products and services that we are providing, we use collected personal data for the following purposes as assigned to the above description of the respective processing activity:

1)    for provision, management and improvement of app services

2)    for prevention of cheating, fraud and any other inappropriate behaviors within apps

3)    for game revenue tracking and related user complaints response

4)    for marketing and advertising distribution

5)    for analytics to optimize our services and improve user experience

6)    for customer support

7)    for communication of promotional offers and pre-registration

4      Our reasons (legal basis) for processing

We process personal data relating to Users if one of the following applies:

1)    necessary for entry into, or performance of, any contract(s) with you (Art 6(1)(b) of the GDPR). This applies to section 2.1 account registration, 3.1) for provision and management of app services; 3.6) for customer support.

2)    necessary for the legitimate interests of us, where these are not overridden by your interests or fundamental rights and freedoms (Art 6(1)(f) of the GDPR). This applies to section 3.1) for improvement of app services; 3.2) for prevention of cheating, fraud and any other inappropriate behaviors within apps; 3.3) for game revenue tracking and related user complaints response.

Note: Our legitimate interests include maintaining and administrating the services, providing the services to you, improving the content of our product and services, ensuring your account is adequately protected as well as compliance with any contractual, legal or regulatory obligations under any applicable law.

3)    necessary for compliance with a legal obligation to which we are subject (Art 6(1)(c) of the GDPR).

4)    in limited circumstances and to the extent the legal bases for processing set out above do not apply, processed with your consent (Art 6(1)(a) of the GDPR). This applies to section 3.4) for marketing and advertising distribution; 3. 5) for analytics to optimize our services and improve user experience; 3. 7) for communication of promotional offers and pre-registration.

5      Sharing of personal data

In order to provide you with more convenient and prompt services, we share your personal data with our partners and entrust other companies with such tasks. We share your personal data with third-party service providers provided these third parties assume confidentiality obligations regarding your personal data collected. We have concluded data processing agreements (as required in accordance with Art 28 of the GDPR) or joint controller agreements (as required in accordance with Art 26 of the GDPR), as applicable, with such third-party service providers.

We have engaged:

1)    analytics service providers (Adjust GmbH) to analyze and keep track of our user behavior and to provide marketing insights. We provide the Mobile advertising identifiers, i.e. iOS IDFAs and Android Advertising IDs (“Mobile IDs”), device ID, system logs including you sign-in data, your usage data such as your in-app purchase records with Adjust based on your consent. If you wish to withdraw your consent, including with regard to the personalization of adverts and content, please go to Article 10 7) Right to withdraw your consent. We suggest you check the privacy policy of Adjust at https://www.adjust.com/terms/privacy-policy/?utm_source=coba.

2)    advertising service providers (Hong Kong Cheerlife Technology Limited) for marketing, advert distribution and promotion purposes. We provide your mobile phone number, your Mobile advertising identifiers, i.e. your Mobile IDs, device ID, system logs including you sign-in data, your usage data such as your in-app purchase records based on your consent. If you wish to withdraw your consent, including with regard to the personalization of adverts and content, please go to Article 10 7) Right to withdraw your consent. For this type of services, it may allow the third party to use and analyze your personal data for other purposes, we suggest that you check the privacy policy of the third-party site at https://cheerlife.info/en/.

3)    other technical service providers involved in the supply of the services (for example, cloud services, customer support, system monitoring and error report).

In addition, we may disclose your personal data in the following cases:

1)    where we are required to do so by European law or legal process.

2)    where we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity, as far as and to the extent permitted and/or required by European laws.

3)    where we sell or transfer all or part of our business or assets (including in the event of a reorganization, dissolution, or liquidation), as far as and to the extent permitted by European laws.

6      Cross-border transfer of personal data

Generally, we will process your personal data in the country/region where we conduct business or provide products and services. However, as part of the services offered to you through our services, the personal data which you provide to us may be transferred to countries outside the European Union (e.g., Singapore and China). To exemplify: this may happen if any of our servers are, from time to time, located in a country outside the EU. These countries may not have similar data protection laws as the EU. We will however take all necessary measures to protect your personal data in accordance with applicable law.

In particular,

1)    if your personal data is transferred to countries/territories with adequacy decision (e.g., Japan), the cross-border transfer is subject to the mechanism of an adequacy decision. (Art 45 of the GDPR)

2)    if your personal data is transferred to other countries/territories, we will evaluate the ability of personal data protection and network security safeguards and take measures from the catalogue set out in (Art 46(2) of the GDPR).

7      Retention and destruction of personal data

We only process and store your personal data for as long as required by the purposes they have been collected for, until you object the use of your personal data in case of the legitimate interest being the legal basis for processing (Art 6(1)(f) of the GDPR) or until you withdraw your consent (Art 6(1)(a) of the GDPR).

In general, we will store your personal data for one year after the termination of your Terms of Services with us, unless the retention of your personal data is necessary to meet legal or regulatory requirements, especially to comply with commercial and tax retention obligations, to resolve potential disputes or to preserve evidence within the scope of the statutory limitation provisions. Should this be the case, we will retain the personal data concerned until the end of the respective statutory period.

Thereafter, your personal data will be securely deleted or destroyed. Personal data stored in an electronic file format will be erased by a technical tool which prevents the recovery of the information. Personal data printed in a paper record, print media or a document is destroyed into scrap.

8      Security of personal data

We process the personal data of users in a proper manner and take appropriate security measures to prevent unauthorized access, disclosure, modification, unauthorized destruction of the personal data or any accidents such as hacking or computer viruses.

The processing of personal data is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition, we restrict the number of staff in charge with access to your personal data to the minimum level and frequently conduct training s and educations so that they comply with the confidentiality obligations with respect to your personal data.

Metal Slug: Commander may contain links to other websites and services run by other organizations. This privacy policy applies only to our product and services of Metal Slug: Commander‚ so we encourage you to read the privacy policies on the other websites and services you visit. We cannot be responsible for the privacy policies and practices of other sites even if you access them using links from our product.

メタルスラッグ:コマンダーのゲスト アカウントを作成する際、当社は お客様のデバイスID および位置情報をお客様の モバイル ・オペレーティングシステムから収集し、アカウント 作成 する際お客様の デバイス 探索する際 およびお客様にお近くのサーバーを提示する際にお客様のお手伝いをいた します。

ソーシャルログインまたはサードパーティーのプラットフォーム(Facebook、Google Play、Apple ID)の お客様のクレデンシャルで 当社の製品 サービスにサインする際には、当社は、当該 ソーシャルメディア サイトまたはサードパーティーのプラットフォームを通じて、お客様の 生年月日 (お客様が未成年者の可能性があると当社が考える場合にはその証拠も含みます および当社と共有することにお客様が同意した個人データを収集することができます。

2.2 当社の製品サービスのご利用中

1)    ゲーム内のユーザーを識別し、 それに関連するゲームデータ レベル、購入記録、進度)を保存するため、 当社はお客様のOpenID (自動的に生成されるゲーム内 アカウントの識別子 )を収集する必要があります。

2)    サービス 管理・運営するため、およびゲーム内の他のユーザーと お客様と のインタラクションの強化を含む、お客様のユーザー エクスペリエンス向上 させる ため、当社は、お客様のゲーム関連データ、すなわち、お客様の 友人情報、ランキング、対戦成績および お客様のゲーム対戦の録画 お客様のゲーム内グループのユーザー情報(もし 、あれば )、ゲーム内のチャット履歴を収集する必要があります。

3)    社内レビューを 実施し、当社のサービスを最適化する ため当社は、お客様のデバイスID、MACアドレス、デバイス ハードウェア情報、オペレーティング システム バージョン、ネットワークの状態および システムログを収集する必要があります。

4)    ゲーム 収益記録し、ユーザーから の関連する苦情に対応するため、当社は、App Store またはGoogle Playから提供された お客様の購入記録を収集する必要があります。お客様がご 購入 になった場合、お客様のカード情報は当社では 保有されず、クレジット/デビットカード取引 におけるオンライン上の 安全な 収集および処理を専門とする App Store またはGoogle Playによって収集されます。

5)    当社の広告戦略を改善し、広告効果を 計測するため、当社は、お客様の携帯電話番号、iOS IDFAまたはAndroid の広告 ID(モバイルID 、デバイス ID、お客様のサインインデータを含むシステム・ログ、お客様の同意の基づくアプリ内の購入記録のようなご利用データ)を収集することができます。当社は、お客様の同意に基づいて、 お客様が当社のサービスをご利用になる際 収集したデータを当社のパートナー と結合することができ、また、このデータを人口統計学、広告、市場調査もしくは その他の分析調査と 結合すること できます。 お客様が広告および コンテンツのパーソナライズについての同意を 撤回するまたはそれに異議を申し立てることを希望される場合、第9条5 お客様の同意を 撤回する権利をご覧ください。

6)    不正行為、詐欺行為、他のユーザー、当社従業員および 当社の正当な権利および利益損なうその他 有害な行為またはメタルスラッグ コマンダー サービス条件で禁止されている一切の 行為 などの一切の不適切な行為を防止 発見し、および監視するため 当社は、App Storeまたは Google Play から提供される、お客様の デバイスID、MACアドレス、デバイス ハードウェア情報、オペレーティングシステム バージョン、ネットワーク の状態、システムログ、ゲームデータおよび 購入記録を収集する必要があります。

7)    お客様のご質問 またはご要望によっては、カスタマーサポート を受けるために当社と連絡がとれるように当社は、 お客様のユーザ 、e-メールアドレス、携帯電話番号などの個人データを収集する必要があります。お客様が ソーシャルメディアを介して当社に ご連絡する場合当社は、お客様のご 質問やご要望に適切にお応えするため にのみ共有することにお客様にご同意 いただいた 、お客様の個人データをその ソーシャルメディア サイトを通じて 収集いたします。

6      個人データの保存および廃棄

当社は、原則として、お客様がメタルスラッグ コマンダー・アカウントを 解約 した後6ヵ月間、お客様の個人データを 保存いたします。但し、 お客様の個人データの 保存が法律上のまたは規制上の要件を満たす必要がある場合、特に商業上および税務上の保存 義務を遵守し、潜在的な紛争を解決し、また は、法定制限条項の範囲内で証拠を保全 する 必要のある場合を除きます。こうした場合、当社はそれぞれの 法定期間終了 までその個人データを保存いたし ます。

2      Types of personal information we collect and method of collection

We collect personal information to the minimum scope necessary for the provision of the game “Metal Slug: Commander “(hereinafter as “Metal Slug: Commander”, the “game” or the “services”). The personal information we collect may be freely provided by the user, or, in case of usage data, collected automatically when using our product and services.

2.1 For account registration

When creating your Metal Slug: Commander guest account, we would collect your device ID and location information from your mobile operating system to assist you in creating the account, finding your device, and recommending you to a nearby server.

When signing into our product and services with a social login or your credentials from a third-party platform (for example, Facebook, Google Play, Apple ID) and we may collect your date of birth and the personal information that you have agreed to share via the social media site or third-party platform in question.

2.2 While using our product and services

1)    to identify the user in the game and save its associated game data (level, purchase record, progress), we need to collect your OpenID (an automatically generated in-game account identifier).

2)    to manage and administer the services and improve your user experience including enhancing your interaction with other users in the game, we need to collect your game-related data, i.e., your friends information, ranking, battle results and videorecords of your game battles, user information of your in-game group (if any), chat history in the game.

3)    to perform internal review and optimize our services, we need to collect your device ID, MAC address, device hardware information, operating system version, network status and system logs.

4)    to keep track of game revenue and respond to related user complaints, we need to collect your purchase records provided by App Store or Google Play. If you make a purchase, your card information is not held by us, it is collected by App Store or Google Play, who specializes in the secure online capture and processing of credit/debit card transactions.

5)    to improve our advertising strategy and to measure ad effectiveness, we may collect your mobile phone number, your iOS IDFAs or Android Advertising IDs (“Mobile IDs, device ID, system logs including you sign-in data, your usage data such as your in-app purchase records based on your consent. We can, based on your consent, combine the data collected with our partners when you use our services and also combine this data with demographic, advertising and market studies or with other analytic surveys. If you wish to withdraw your consent or object to the personalization of adverts and content, please go to Article 8) to withdraw your consent.

6)    to prevent, detect and monitor any inappropriate conduct such as cheating, fraud and other toxic behaviors to the detriment of legitimate rights and interests of other users, our employees and company or any behaviors prohibited by the Terms of Service for Metal Slug: Commander. We need to collect your device ID, MAC address, device hardware information, operating system version, network status, system logs, game data and purchase records provided by App Store or Google Play.

7)    to contact us for customer support, we need to collect personal information such as your username, e-mail address, mobile phone number, depending on your questions or requests. If you contact us via social media, we will collect your personal information that you have agreed to share via the social media site only to appropriately respond to your questions and requests.

2.3 For promotional offers and pre-registration

When taking part in a contest or survey organized by us or pre-registering our product and services, we collect your last name, mobile phone number, email address, date of birth and if you participate via social media, we will collect your personal information that you have agreed to share via the social media sites only to administer the contest or the survey, to send you promotional offers and/or for internal statistical purposes.

3)    other technical service providers involved in the supply of the services (for example, cloud services, customer support, system monitoring and error report).

5      Retention and destruction of personal information
